BUSINESS POLICIES

COPYRIGHT INFORMATION: All images copyrighted by photographer, Jacqueline Potter. It is illegal and unlawful to scan, copy, or reproduce Jacqueline Potter work in any manner or medium and punishable by law with fines starting at $150,000. As an artist, Jacqueline Potter wishes to have complete control over the final look of her client's images, and scanned images damage her reputation as a photographer by distorting and devaluing the image quality.

 Thank you for respecting Jacqueline Potter's work and livelihood by choosing not to reproduce her images.

Groupon Sessions and Gift Vouchers : To book a Groupon session you must have a voucher. To hold your date, a contract must be signed within 48 hours of your date or your slot becomes open for others. Your viewing and choosing session will also be scheduled to select your photos. This will occur 1-2 weeks following your session. Prints will take about a 2 week turn around. Other products can take up to 6 weeks depending on what is ordered. Boudoir sessions will occur on weekdays by appointment based on availability, this can change at any notice. Viewing and ordering sessions will occur on Sundays and will last 60-90 minutes. If anything changes, I will update my policies. Thank you for your understanding.

PRINT ORDERS: Packages must be made and paid in full prior to the ordering session. Due to the custom nature of your photographs, there will be no refunds once the order is placed and digital negatives are delivered.

EXCLUSIVE PHOTOGRAPHER: Please only bring the people that will be photographed to the session. Also, please do not bring your own camera, camcorder, or recording device to the session.

BEFORE THE SESSION: If hair and makeup is not included in your package, please arrive hair and makeup ready. There isn’t enough time to do hair and makeup for your session as I shoot sessions back to back. Any time you spend getting ready during your session is taken out of your session time. It isn’t fair to the client following you for me to start late because you were not ready to go on time.

Be sure to wear outfits that fit properly. Outfits that are too big or too small will not look right in the photographs. Any imperfections form ill fitting outfits will not be “photoshopped” as that takes time. Any additional edits outside of basic edits will be a charge of $50/hr with a 2-hour minimum.

MINI SESSIONS DO NOT INCLUDE HAIR AND MAKEUP; PLEASE ARRIVE HAIR AND MAKEUP READY.

AFTER YOUR SESSION: Your photos will be ready for viewing at your personal viewing and ordering appointment 1-2 weeks following your session. First, I'm going to be upfront, all decisions have to be made at your photo ordering appointment and all sales are final.  I'm not able to set up multiple appointments per person, so you need to be prepared to make all decisions at this appointment.  You must attend this appointment.  You cannot send someone else in place of yourself.  If you send someone else, I will have to send them away and will not be able to show the photos.  Children may not come to this appointment.  If a child between infant and 17 is brought to the appointment, we will have to reschedule. If you're not able to make it to your ordering appointment, please give me as much notice as possible as I'm probably paying for childcare ( is school is not in session) for that time and may not be able to schedule someone else for that slot.  If you don't show up to your appointment or give me less than 48 hours notice of a reschedule, there will be a $100 rescheduling fee. Your will be asked for your credit card information upon booking. Your card will NOT be charged unless you do not give a 48 hour notice. Unfortunately, anything you don't sign a model release for and do not order will be deleted.  

PRINT CREDITS: Print credits do not have a cash value. This is a credit towards an order if you so choose to purchase anything that is included with your package/session. The print credit cannot be given as back as cash if you choose not to place an order. Your credit cannot be transferred to another session, or to anyone else.
 

PRICING AND PRODUCTS

Immediately after your session, you will receive a list of products and pricing. I do not email it this ahead of time. I do this so while you are at the studio you have the opportunity to see the product offerings for yourself. I will have samples for you to touch and feel so you can see if there is anything you would like should you choose to purchase anything outside of what’s included in your session. **Pricing is subject to change without notice, this includes sessions and products**

FINAL PRINTS: Your final print order will be delivered approximately 2-3 weeks after your previewing session. Canvases and other products may take up to 4-6 weeks. Jacqueline Potter will contact you by phone in order to set up a convenient time for your images to be delivered.  You will receive the 5x7 or 8x10 digital files when your products are delivered on your beautiful USB (If your session includes or you have purchased digital files).

PORTRAIT CARE: Handle your portraits with extreme care. Damage incurred as a result of improper handling, framing or hanging is the responsibility of the client.

RETAINER POLICY: A non-refundable retainer for your session is due at signing of the contract to book your appointment. This guarantees the time and date allotted for you. The remainder of the balance is due 7 days before the session. Should payment not be received in this time frame, American Memories Photography services, LLC reserves the right to offer the date and time to another client.  If the session must be rescheduled (up to two times), the session must take place within 6 months of the date the contract was signed. If it does not, then a new contract must be signed, and a new retainer/session fee must be paid at current pricing.

SALES ARE FINAL: Due to the custom nature of each session, all sales final. You will sign a product delivery agreement once viewing session is complete and products/files have been received. Any payments made on a payment plan are non refundable if you choose to cancel your order before it is paid off to offset business expenses toward your order.

PRICING AND PRODUCTS:

All Product and session pricing is readily available through the website. Session info is located under "Book Now" and Product pricing is under "The experience".  I will have samples for you to touch and feel so you can see if there is anything you would like should you choose to purchase anything outside of what’s included in your session.

PAYMENT PLANS: Payment plans are between 3-6 months. If you would like to receive your products faster, full payment is accepted by credit card, paypal credit, or cash. I am sorry, but I no longer accept checks.

To start your payment plan, we will decide on the number of payments and what day of the month you would like to be billed. I do require the first installment be due that day as a down payment.

You will then sign a credit card agreement allowing me to automatically bill your credit card every month until everything has been paid off. I will take two credit card numbers. One of them being a primary, and the other a secondary if the first card does not go through.

I only place orders once your products have been paid off.

Please allow 4-6 weeks for products to arrive once your album proofs have been approved by you. Once approved, your order will be placed.

7% Florida state sales tax is added to all orders

RETOUCHING: Any retouching beyond the basic retouching we automatically do (small facial scars, blemishes, eye circles, visible tan lines) will be charged a fee of $50 per hour. This includes braces, removal of logos/words on shirts, etc.

RAW and Unedited Images: RAW and unedited images are not available for viewing or for sale.

ALBUM POLICIES: Oftentimes American Memories Photography will show an image in both black and white, and color. When purchasing the session album, you will not receive both versions of an image; rather Jacqueline Potter will include whichever version is artistically more appealing.

DIGITAL FILES: If you have purchased digital files, it is your responsibility to back them up. Once they have been delivered, I am no longer liable to hold on to your order indefinitely. I will only hold on to ordered images for one year.

PRINTING OF FILES: Photographer is not responsible of the quality of prints from third party printers such as home printers, Walmart, Walgreens, Sams, etc. The colors that show on the prints may not match the way the photos look on your computer screen, resulting in lower quality images. American Memories Photography places orders through a professional lab that can color correct and control the quality of the final product. This way the colors match and can be corrected if need be.

RE-SHOOTS: Re-shoots are at the discretion of the photographer; and are not given for regretful personal choices such as hair and clothing choices.

UNDER THE WEATHER: If you are feeling ill, please call to reschedule. American Memories Photography understands that sometimes, this happens. If you must cancel, please try to do so at least 48 hours before your session.

TRAVEL FEE: There is a $0.80/mile travel fee for locations 30 miles outside of 32225.

PAYMENT OPTIONS: American Memories Photography accepts cash; VISA, MasterCard and Paypal Credit.

PERSONAL CHECKS: I no longer accept personal checks.

USAGE: American Memories Photography reserves the right to use the negatives and/or reproductions for display, publication, or other purposes. I do respect your privacy, and if you do not choose to allow me to share photos, I do have you express that in writing by signing a form at your viewing. Negatives and originals remain the property of American Memories Photography/American Vixen Boudoir Studio regardless of permissions granted by the client.

REPRINTS: All ordered images will be kept on file for one year after your initial order. All images that are not ordered will be deleted following your viewing/ordering session. You are welcome to place a re-print order from the images you originally purchased. There is a $100 minimum on re-prints.

INDEMNIFICATION: The Photographer shall be held harmless (not responsible) for any and all injury to Client during the course of the photographic event and the immediately surrounding events.

 Now that you have read all my polices, and we got all of the business stuff out of the way, let’s have some fun! I want this to be a relaxed, fun experience, not just a typical session.
